Local residents reported demolition contractor who failed to implement and Asbestos Demolition Survey

Local residents in the Wimbledon Chase tube station area raised the alarm when they noticed that workers on a nearby site were smashing up asbestos containing materials (ACM’s), dropping the material from a great height and leaving it littering the site. Further concerns were raised as the site, which was near to a school, was not properly secured.

The Health and Safety Executive launched an investigation back in February 2011 which has resulted in the ruling that AA Construction (London) Ltd had failed to properly plan the work. They were served three enforcement notices relating to unsafe practices that forced the site to be closed until urgent improvements were made.

Westminster Magistrates’ Court heard the company should have carried out an asbestos survey and produced a health and safety plan, including a demolition plan to ensure the buildings were demolished in a safe manner. Various types of equipment should have been used to ensure the demolition was safe and adhered to health and safety legislation. Also, the ACM’s should have been removed intact to prevent the release of fibres, segregated and correctly disposed of, and debris should have been progressively cleared allowing for safe access around the site.

In addition, AA Construction also employed inexperienced labourers to carry out demolition and asbestos removal, and did not give them sufficient instruction, training, or supervision AA Construction (London) Ltd pleaded guilty to these serious safety breaches and was fined £36,000 with £9,159 in costs.

After the hearing, HSE Inspector Helen Donnelly said “AA Construction (London) Ltd took a reckless approach to demolition, which could have resulted in a serious incident”.
